Allgemeine Geschäftsbedingungen (AGB) für die SWAY Loyalty Platform von Apollobase GmbH

Willkommen auf der SWAY Loyalty Plattform für unseren Nachtclub, zur Verfügung gestellt von Apollobase GmbH. Durch den Zugriff auf und die Nutzung unserer mobilen SWAY-Anwendung erklären Sie sich mit den unten aufgeführten Bedingungen einverstanden.
DEFINITIONEN
1.1. “Anwendung” oder “App” bezieht sich auf die mobile Anwendung der SWAY-Treueplattform, die von Apollobase GmbH entwickelt wurde und ihr gehört.
1.2. “Nutzer” bezieht sich auf jede Person, die auf die SWAY-App zugreift und diese nutzt, unabhängig davon, ob sie registriert ist oder nicht.
1.3. “Registrierter Benutzer” bezieht sich auf Benutzer, die den Registrierungsprozess in der SWAY-App abgeschlossen haben.
ZUGANG UND NUTZUNG
2.1. Alle Nutzer, unabhängig von ihrem Registrierungsstatus, sind berechtigt, Veranstaltungsankündigungen über die SWAY-App zu lesen.
2.2. Nur registrierte Nutzer können die Mitgliederpass-Funktion nutzen, um den Club zu betreten, Rabatte in Anspruch zu nehmen, Treuepunkte zu sammeln und ihren Kontostand und ihre Transaktionen innerhalb der SWAY-App zu überprüfen.
REGISTRIERUNG UND AUTHENTIFIZIERUNG
3.1. Um ein registrierter Nutzer in der SWAY-App zu werden, muss eine Person eine gültige Handynummer angeben.
3.2. Nach Angabe der Handynummer wird ein Authentifizierungscode per SMS gesendet. Dieser Code ist erforderlich, um den Registrierungsprozess innerhalb der SWAY-App abzuschließen.
3.3. Jede Handynummer kann nur für eine Kontoregistrierung in der SWAY-App verwendet werden.
3.4. Registrierte Nutzer sind dafür verantwortlich, die Vertraulichkeit ihrer SWAY-Kontoinformationen zu gewährleisten.
LOYALITÄTSPUNKTE
4.1. Treuepunkte können durch Scannen von QR-Codes auf gültigen Quittungen des Clubs innerhalb der SWAY-App erworben werden.
4.2. Die Bedingungen für Treuepunkte, wie z. B. ihr Wert, ihr Verfall und ihre Einlösung, können sich ändern und werden in einem separaten Abschnitt der SWAY-Anwendung angegeben.
DATENSCHUTZ
5.1. Apollobase GmbH verpflichtet sich, die Privatsphäre seiner Nutzer innerhalb der SWAY-App zu schützen. Die erhobenen Daten werden in Übereinstimmung mit den einschlägigen deutschen Datenschutzbestimmungen verwendet.

HAFTUNGSAUSSCHLÜSSE
6.1. Die SWAY-Anwendung wird ohne Mängelgewähr und ohne ausdrückliche oder stillschweigende Garantien bereitgestellt.
6.2. Apollobase GmbH ist nicht verantwortlich für Verluste, Schäden oder Beeinträchtigungen, die sich aus der Nutzung der SWAY-Anwendung ergeben.
HAFTUNGSBESCHRÄNKUNG
7.1. Soweit gesetzlich zulässig, haftet Apollobase GmbH nicht für direkte, indirekte, zufällige oder Folgeschäden, die sich aus der Nutzung oder der Unfähigkeit zur Nutzung der SWAY-App ergeben.
KÜNDIGUNG
8.1. Apollobase GmbH behält sich das Recht vor, das SWAY-Konto eines Benutzers ohne Vorankündigung zu sperren oder zu kündigen, wenn Apollobase GmbH der Ansicht ist, dass das Verhalten gegen diese AGB verstößt oder für andere Benutzer, Apollobase GmbH oder Dritte schädlich ist, oder aus anderen Gründen.
ÄNDERUNGEN
9.1. Apollobase GmbH behält sich das Recht vor, diese TOS jederzeit zu ändern. Änderungen werden in der SWAY-App veröffentlicht, und es liegt in der Verantwortung des Nutzers, sicherzustellen, dass er über alle Aktualisierungen informiert ist.
GELTENDES RECHT
10.1. Diese ANB unterliegen deutschem Recht und werden nach diesem ausgelegt. Streitigkeiten im Zusammenhang mit diesen AGB unterliegen der ausschließlichen Zuständigkeit der deutschen Gerichte.

Apollobase GmbH respects your privacy and is committed to protecting your personal data. This Privacy Policy will inform you about how we look after your personal data when you use our SWAY Loyalty Platform Mobile Application (referred to as “SWAY App”) and tell you about your privacy rights and how the law protects you.
- SCOPE OF THIS PRIVACY POLICY
This Privacy Policy applies to data we collect when you use the SWAY App. It doesn’t cover any third-party websites or services linked to our SWAY App.

- Contact Data includes mobile phone number.
- Transaction Data includes details about payments to and from you, and details of loyalty points earned and redeemed through the SWAY App.

We collect data through direct interactions (when you provide your mobile number for registration and loyalty points transactions within the SWAY App) and automated technologies (when you use the SWAY App, we may automatically collect Technical Data).

- Performance of Contract: This involves processing data for registration purposes within the SWAY App.
